Introduction

The rapid advancement of technology, including generative AI, offers immense benefits but also raises concerns about misuse. The Internet Watch Foundation reported that, as of July 2024, over 3,500 new AI-generated child sexual abuse images appeared on the dark web. The UK’s National Crime Agency records 800 monthly arrests for online child threats and estimates 840,000 adults as potential offenders. In response, the UK is introducing legislation to criminalise AI-generated child exploitation imagery, which will be a part of the Crime and Policing Bill when it comes to parliament in the next few weeks, aligning with global AI regulations like the EU AI Act and the US AI Initiative Act. This policy shift strengthens efforts to combat online child exploitation and sets a global precedent for responsible AI governance.

Current Legal Landscape and the Policy Gap 

The UK’s Online Safety Act 2023 aims to combat CSAM and deepfake pornography by holding social media and search platforms accountable for user safety. It mandates these platforms to prevent children from accessing harmful content, remove illegal material, and offer clear reporting mechanisms. For adults, major platforms must be transparent about harmful content policies and provide users control over what they see.

However, the Act has notable limitations, including concerns over content moderation overreach, potential censorship of legitimate debates, and challenges in defining "harmful" content. It may disproportionately impact smaller platforms and raise concerns about protecting journalistic content and politically significant discussions. While intended to enhance online safety, these challenges highlight the complexities of balancing regulation with digital rights and free expression. 

The Proposed Criminalisation of AI-Generated Sexual Abuse Content

The proposed law by the UK criminalises the creation, distribution, and possession of AI-generated CSAM and deepfake pornography. It mandates enforcement agencies and digital platforms to identify and remove such content, with penalties for non-compliance. Perpetrators may face up to two years in prison for taking intimate images without consent or installing equipment to facilitate such offences. Currently, sharing or threatening to share intimate images, including deepfakes, is an offence under the Sexual Offences Act 2003, amended by the Online Safety Act 2023. The government plans to repeal certain voyeurism offences, replacing them with broader provisions covering unauthorised intimate recordings. This aligns with its September 2024 decision to classify sharing intimate images as a priority offence under the Online Safety Act, reinforcing its commitment to balancing free expression with harm prevention.

Implications for AI Regulation and Platform Responsibility

The UK's move aligns with its AI Safety Summit commitments, placing responsibility on platforms to remove AI-generated sexual abuse content or face Ofcom enforcement. The Crime and Policing Bill is expected to tighten AI regulations, requiring developers to integrate safeguards against misuse, and the licensing frameworks may enforce ethical AI standards, restricting access to synthetic media tools. Given AI-generated abuse's cross-border nature, enforcement will necessitate global cooperation with platforms, law enforcement, and regulators. Bilateral and multilateral agreements could help harmonise legal frameworks, enabling swift content takedown, evidence sharing, and extradition of offenders, strengthening international efforts against AI-enabled exploitation.

Conclusion and Policy Recommendations 

The Crime and Policing Bill marks a crucial step in criminalising AI-generated CSAM and deepfake pornography, strengthening online safety and platform accountability. However, balancing digital rights and enforcement remains a challenge. For effective implementation, industry cooperation is essential, with platforms integrating detection tools and transparent reporting systems. AI ethics frameworks should prevent misuse while allowing innovation, and victim support mechanisms must be prioritised. Given AI-driven abuse's global nature, international regulatory alignment is key for harmonised laws, evidence sharing, and cross-border enforcement. This legislation sets a global precedent, emphasising proactive regulation to ensure digital safety, ethical AI development, and the protection of human dignity.

Introduction

As e-sports flourish in India, mobile gaming platforms and apps have contributed massively to this boom. The wave of online mobile gaming has led to a new recognition of esports. As we see the Sports Ministry being very proactive for e-sports and e-athletes, it is pertinent to ensure that we do not compromise our cyber security for the sake of these games. When we talk about online mobile gaming, the most common names that come to our minds are PUBG and BGMI. As news for all Indian gamers, BGMI is set to be relaunched in India after approval from the Ministry of Electronics and Information Technology.

Why was BGMI banned?

The Govt banned Battle Ground Mobile India on the pretext of being a Chinese application and the fact that all the data was hosted in China itself. This caused a cascade of compliance and user safety issues as the Data was stored outside India. Since 2020 The Indian Govt has been proactive in banning Chinese applications, which might have an adverse effect on national security and Indian citizens. Nearly 200 plus applications have been banned by the Govt, and most of them were banned due to their data hubs being in China. The issue of cross-border data flow has been a key issue in Geo-Politics, and whoever hosts the data virtually owns it as well and under the potential threat of this fact, all apps hosting their data in China were banned.

Why is BGMI coming back?

BGMI was banned for not hosting data in India, and since the ban, the Krafton Inc.-owned game has been engaging in Idnai to set up data banks and servers to have a separate gaming server for Indian players. These moves will lead to a safe gaming ecosystem and result in better adherence to the laws and policies of the land. The developers have not declared a relaunch date yet, but the game is expected to be available for download for iOS and Android users in the coming few days. The game will be back on app stores as a letter from the Ministry of Electronics and Information Technology has been issued stating that the games be allowed and made available for download on the respective app stores.

Grounds for BGMI

BGMI has to ensure that they comply with all the laws, policies and guidelines in India and have to show the same to the Ministry to get an extension on approval. The game has been permitted for only 90 days (3 Months). Hon’ble MoS Meity Rajeev Chandrashekhar stated in a tweet   “This is a 3-month trial approval of #BGMI after it has complied with issues of server locations and data security etc. We will keep a close watch on other issues of User harm, Addiction etc., in the next 3 months before a final decision is taken”. This clearly shows the magnitude of the bans on Chinese apps. The ministry and the Govt will not play the soft game now, it’s all about compliance and safeguarding the user’s data.

Way Forward

This move will play a significant role in the future, not only for gaming companies but also for other online industries, to ensure compliance. This move will act as a precedent for the issue of cross-border data flow and the advantages of data localisation. It will go a long way in advocacy for the betterment of the Indian cyber ecosystem. Meity alone cannot safeguard the space completely, it is a shared responsibility of the Govt, industry and netizens.

The provisional permission form BGMI shows the stance of the Govt and how it is following the no-tolerance policy for noncompliance with laws. In our previous blog we discussed the difference between copying, cloning, and imaging in the context of Digital Forensics, and found out why imaging is a better process. Today we will discuss the process of evidence collection in Digital Forensics. The whole process starts with making sure the evidence collection team has all necessary tools required for the task.

Investigating Tools and Equipment:

Below are some mentioned tools that the team should carry with them for a successful evidence collection:

Evidence Collection

The investigators encounter two primary types of evidence during the course of gathering evidence: non-electronic and electronic evidence.

The following approaches could be used to gather non-electronic evidence:

• In the course of looking into electronic crimes, recovering non-electronic evidence can be extremely important.  Be cautious to make sure that this kind of evidence is retrieved and kept safe. Items that may be relevant to a later review of electronic evidence include passwords, papers or printouts, calendars, literature, hardware and software manuals, text or graphical computer printouts, and photos.  These items should be secured and kept for further examination.
• They are frequently found close to the computer or other related hardware.  Locating, securing, and preserving all evidence is required by departmental procedures.

Three scenarios arise for the collection of digital evidence from computers: 

Situation 1: The desktop is visible, and the monitor is on.

• Take a picture of the screen and note the data that is visible. 
• Utilize tools for memory capturing to gather volatile data.
• Look for virtual disks. If so, gather mounted data's logical copies.
• Give each port and connection a label.
• Take a picture of them.
• Turn off network access to stop remote access.
• Cut off the power or turn it off.
• Locate and disconnect the hard drive by opening the CPU chassis.
• Take all evidence and place it in anti-magnetic (Faraday) bags.
• Deliver the evidence to the forensic lab.
• Keep the chain of custody intact.

Situation 2: The monitor is turned on, but it either has a blank screen (sleep mode) or an image for the screensaver.

• Make a small mouse movement (without pressing buttons). The work product should appear on the screen, or it should ask for a password.
• If moving the mouse does not result in a change to the screen, stop using the mouse and stop all keystrokes.
• Take a picture of the screen and note the data that is visible.
• Use memory capturing tools to gather volatile data (always use a write blocker to prevent manipulation during data collection).
• Proceed further in accordance with Situation 1.

Situation 3: The Monitor Is Off

• Write down the "off" status.
• After turning on the monitor, check to see if its status matches that of situations 1 or 2 above, and then take the appropriate action.
• Using a phone modem, cable, confirm that you are connected to the outside world. Try to find the phone number if there is a connection to the phone.
• To protect evidence, take out the floppy disks that might be there, package each disk separately, and label the evidence.  Put in a blank floppy disk or a seizure disk, if one is available. Avoid touching the CD drive or taking out CDs.
• Cover the power connector and every drive slot with tape.
• Note the serial number, make, and model.
• Take a picture of the computer's connections and make a diagram with the relevant cables.
• To enable precise reassembly at a later date, label all connectors and cable ends, including connections to peripheral devices. Put "unused" on any connection ports that are not in use.  Recognize docking stations for laptop computers in an attempt to locate additional storage media.
• All evidence should be seized and placed in anti-magnetic (Faraday) bags.

• Put a tag or label on every bag.
• Deliver the evidence to the forensic lab.
• Keep the chain of custody intact. 

Following the effective gathering of data, the following steps in the process are crucial: data packaging, data transportation, and data storage.

The following are the steps involved in data packaging, transportation, and storage:

Packaging:

• Label every computer system that is gathered so that it can be put back together exactly as it was found

When gathering evidence at a scene of crime,

• Before packing, make sure that every piece of evidence has been appropriately  labeled and documented.
• Latent or trace evidence requires particular attention, and steps should be taken to preserve it.
• Use paper or antistatic plastic bags for packing magnetic media to prevent static electricity. Do not use materials like regular plastic bags (instead use faraday bags) that can cause static electricity. 
• Be careful not to bend, fold, computer media like tapes, or CD-ROM.
• Make sure that the labels on every container used to store evidence are correct.

Transporting

• Make sure devices are not packed in containers and are safely fastened inside the car to avoid shock and excessive vibrations. Computers could be positioned on the floor of the car,and monitors could be mounted on the seat with the screen down .

When transporting evidence—

• Any electronic evidence should be kept away from magnetic sources.  Radiation transmitters, speaker magnets, and heated seats are a few examples of items that can contaminate electronic evidence.
• Avoid leaving electronic evidence in your car for longer than necessary. Electronic devices can be harmed by extremes in temperature, humidity.
• Maintain the integrity of the chain of custody while transporting any evidence.

Storing

• Evidence should be kept safe and away from extremes in humidity and temperature. Keep it away from dust, moisture, magnetic devices, and other dangerous impurities.  Be advised that extended storage may cause important evidence—like dates, times, and system configurations—to disappear. Because batteries have a finite lifespan, data loss may occur if they malfunction. Whenever the battery operated device needs immediate attention, it should be informed to the relevant authority (eg., the chief of laboratory, the forensic examiner, and the custodian of the evidence). 

CONCLUSION:

Thus, securing the crime scene to packaging, transportation and storage of data are the important steps in the process of collecting digital evidence in forensic investigations. Keeping the authenticity during the process along with their provenance is critical during this phase. It is also important to ensure the admissibility of evidence in legal proceedings. This systematic approach is essential for effectively investigating and prosecuting digital crimes.
