Our research revealed that the viral video is AI-generated and is being shared with a misleading claim.
Claim:
A user on the social media platform Instagram shared the viral video with the caption: “The situation in Nepal looks extremely frightening after the floods. Floodwater has covered the area, and the frightened face of a little girl amid the water is moving everyone emotionally. Seeing the innocent girl’s condition in this difficult situation has raised concerns among people.”

Fact Check
A reverse image search of keyframes from the viral video on Google did not yield any credible media reports related to the video. Upon closely examining the viral video, we suspected that it might be AI-generated. We subsequently scanned the video using the AI detection tool Hive Moderation. According to the results, the video has a 99 percent probability of being AI-generated.

As part of the next step of ourresearch, we scanned the viral video using another AI detection tool, Sightengine. According to the results, the video has a 99 percent probability of being AI-generated.

Conclusion
Our research found that the viral video is AI-generated and is being shared with a misleading claim.

When she rings the doorbell again to request the payment, a second man joins him. The duo is then seen forcibly dragging the woman inside the residence. Moments later, she emerges from the house visibly distressed and injured, suggesting physical assault.

Fact Check
A Google Reverse Image Search led the Desk to a video posted on a Facebook page named 3RD EYE, which had over 1.1 million followers at the time of publication of this story. The page had shared the same video on June 21, showing a food delivery agent being assaulted, as seen in the viral social media posts. However, upon carefully reviewing the disclaimer accompanying the video, the Desk found that it was scripted and not based on any real-life incident.
The disclaimer clearly stated that the video was intended to raise awareness, entertain and educate viewers. The page caption read: “Thank you for watching! Please note that this page features scripted dramas, parodies, and awareness videos. These short films are created for entertainment and educational purposes only. All characters and situations depicted in the videos are fictional and intended to raise awareness, entertain and educate.”

Further inspection of the '3RD EYE' Facebook channel confirmed a routine pattern of posting scripted awareness clips and fictional dramatizations.

Misinformation is a major issue in the AI age, exacerbated by the broad adoption of AI technologies. The misuse of deepfakes, bots, and content-generating algorithms have made it simpler for bad actors to propagate misinformation on a large scale. These technologies are capable of creating manipulative audio/video content, propagate political propaganda, defame individuals, or incite societal unrest. AI-powered bots may flood internet platforms with false information, swaying public opinion in subtle ways. The spread of misinformation endangers democracy, public health, and social order. It has the potential to affect voter sentiments, erode faith in the election process, and even spark violence. Addressing misinformation includes expanding digital literacy, strengthening platform detection capabilities, incorporating regulatory checks, and removing incorrect information.
AI's Role in Misinformation Creation
AI's growth in its capabilities to generate content have grown exponentially in recent years. Legitimate uses or purposes of AI many-a-times take a backseat and result in the exploitation of content that already exists on the internet. One of the main examples of misinformation flooding the internet is when AI-powered bots flood social media platforms with fake news at a scale and speed that makes it impossible for humans to track and figure out whether the same is true or false.
The netizens in India are greatly influenced by viral content on social media. AI-generated misinformation can have particularly negative consequences. Being literate in the traditional sense of the word does not automatically guarantee one the ability to parse through the nuances of social media content authenticity and impact. Literacy, be it social media literacy or internet literacy, is under attack and one of the main contributors to this is the rampant rise of AI-generated misinformation. Some of the most common examples of misinformation that can be found are related to elections, public health, and communal issues. These issues have one common factor that connects them, which is that they evoke strong emotions in people and as such can go viral very quickly and influence social behaviour, to the extent that they may lead to social unrest, political instability and even violence. Such developments lead to public mistrust in the authorities and institutions, which is dangerous in any economy, but even more so in a country like India which is home to a very large population comprising a diverse range of identity groups.
Misinformation and Gen AI
Generative AI (GAI) is a powerful tool that allows individuals to create massive amounts of realistic-seeming content, including imitating real people's voices and creating photos and videos that are indistinguishable from reality. Advanced deepfake technology blurs the line between authentic and fake. However, when used smartly, GAI is also capable of providing a greater number of content consumers with trustworthy information, counteracting misinformation.
Generative AI (GAI) is a technology that has entered the realm of autonomous content production and language creation, which is linked to the issue of misinformation. It is often difficult to determine if content originates from humans or machines and if we can trust what we read, see, or hear. This has led to media users becoming more confused about their relationship with media platforms and content and highlighted the need for a change in traditional journalistic principles.
We have seen a number of different examples of GAI in action in recent times, from fully AI-generated fake news websites to fake Joe Biden robocalls telling the Democrats in the U.S. not to vote. The consequences of such content and the impact it could have on life as we know it are almost too vast to even comprehend at present. If our ability to identify reality is quickly fading, how will we make critical decisions or navigate the digital landscape safely? As such, the safe and ethical use and applications of this technology needs to be a top global priority.
Challenges for Policymakers
AI's ability to generate anonymous content makes it difficult to hold perpetrators accountable due to the massive amount of data generated. The decentralised nature of the internet further complicates regulation efforts, as misinformation can spread across multiple platforms and jurisdictions. Balancing the need to protect the freedom of speech and expression with the need to combat misinformation is a challenge. Over-regulation could stifle legitimate discourse, while under-regulation could allow misinformation to propagate unchecked. India's multilingual population adds more layers to already-complex issue, as AI-generated misinformation is tailored to different languages and cultural contexts, making it harder to detect and counter. Therefore, developing strategies catering to the multilingual population is necessary.
Potential Solutions
To effectively combat AI-generated misinformation in India, an approach that is multi-faceted and multi-dimensional is essential. Some potential solutions are as follows:
- Developing a framework that is specific in its application to address AI-generated content. It should include stricter penalties for the originator and spreader and dissemination of fake content in proportionality to its consequences. The framework should establish clear and concise guidelines for social media platforms to ensure that proactive measures are taken to detect and remove AI-generated misinformation.
- Investing in tools that are driven by AI for customised detection and flagging of misinformation in real time. This can help in identifying deepfakes, manipulated images, and other forms of AI-generated content.
- The primary aim should be to encourage different collaborations between tech companies, cyber security orgnisations, academic institutions and government agencies to develop solutions for combating misinformation.
- Digital literacy programs will empower individuals by training them to evaluate online content. Educational programs in schools and communities teach critical thinking and media literacy skills, enabling individuals to better discern between real and fake content.

AI-generated misinformation presents a significant threat to India, and it is safe to say that the risks posed are at scale with the rapid rate at which the nation is developing technologically. The battle against misinformation is complex and ongoing, but by developing and deploying the right policies, tools, digital defense frameworks and other mechanisms, we can navigate these challenges and safeguard the online information landscape.

The courts in India have repeatedly emphasised the importance of “enhanced customer protection” and “limited liability” on their part. The rationale behind such imperatives is to extend security against exploitation by institutions that are equipped with all the means to manipulate customers. India, with its looming financial literacy gaps that have to be addressed, needs to curb any manipulation on the part of banking institutions. Various studies have highlighted this gap in recent times; for example, according to the National Centre for Financial Education, only 27% of Indian people are financially literate, which is much less than the 42% global average. With only 19% of millennials exhibiting sufficient financial awareness yet expressing high trust in their financial skills, the issue is very worrisome. Thus, the increasing number of financial frauds intensifies the issue.
Zero Liability in Cyber Frauds: Regulatory Safeguards for Digital Banking Customers
In light of the growing emphasis on financial inclusion and consumer protection, and in response to the recent rise in complaints regarding unauthorised debits from customer accounts and cards, the framework for assessing customer liability in such cases has been re-evaluated. The RBI’s circular dated July 6, 2017 titled “Customer Protection-Limited Liability of Customers in Unauthorised Electronic Banking Transactions” serves as the foundation for regulatory protections for Indian customers of digital banking. A clear and organised framework for determining customer accountability is outlined in the circular, which acknowledges the exponential increase in electronic transactions and related scams. It assigns proportional obligations for unauthorised transactions resulting from system-level breaches, client carelessness, and bank contributory negligence. Most importantly it establishes the zero responsibility concept, which protects clients from monetary losses in cases when the bank or another system component is at fault and the client promptly reports the breach.
This directive’s sophisticated approach to consumer protection is what makes it unique. It requires banks to set up strong fraud prevention systems, proactive alerting systems, and round-the-clock reporting systems. Furthermore, it significantly alters the power dynamics between financial institutions and customers by placing the onus of demonstrating customer negligence completely on the bank. The circular emphasises prompt reversal of funds to impacted customers and requires banks to implement Board-approved policies on liability to redress. As a result, it is a consumer rights charter rather than just a compliance document, promoting confidence and financial accountability in India’s digital banking sector.
Judicial Endorsement in Reinforcing the Zero Liability Principle
In the case of Suresh Chandra Negi & Anr. v. Bank of Baroda & Ors. (Writ (C) No. 24192 of 2022) The Allahabad High Court reaffirmed that the burden of proving consumer accountability rests firmly on the banking institution, hence reaffirming the zero liability concept in circumstances of unapproved electronic banking transactions. The Division bench emphasised the regulatory requirement that banks provide adequate proof before assigning blame to customers, citing Clause 12 of the RBI’s circular dated June 6, 2017, Customer Protection—Limited Liability of Customers in Unauthorised Electronic Banking Transactions. In a similar scenario, the Bombay HC held that a customer is entitled to zero liability when an authorized transaction occurs due to a third-party breach, where the deficiency lies neither with the bank nor the customer, provided the fraud is promptly reported.
The zero liability principle, as envisaged under Clause 8 of the RBI circular, has emerged as a cornerstone of consumer protection in India’s digital banking ecosystem.
Another landmark judgment that has given this principle the front stage in addressing banking frauds is Hare Ram Singh vs RBI &Ors. (W.P. (C) 13497/2022) laid down by Delhi HC which is an important legal turning point in the development of the zero liability principle under the RBI’s 2017 framework. The court reiterated the need to evaluate customer diligence in light of new fraud tactics like phishing and vishing by holding the State Bank of India (SBI) liable for a cyber fraud incident even though the transactions were authenticated by OTP. The ruling made it clear that when complex social engineering or technical manipulation is used, banks are nonetheless accountable even if they only rely on OTP validation. The legal protection provided to victims of unauthorised electronic banking transactions is strengthened by the court’s emphasis on the bank having the burden of evidence in accordance with RBI standards.
Importantly, this ruling lays the full burden of securing digital banking systems on financial organisations and supports the judiciary’s increasing acknowledgement of the digital asymmetry between banks and consumers. It emphasises that prompt consumer reporting, banks’ failure to disclose important credentials, and their own operational errors must all be taken into consideration when determining culpability. As a result, this decision establishes a strong precedent that will increase consumer confidence, promote systemic advancements in digital risk management, and better integrate the zero liability standard into Indian digital banking law. In a time when cyber vulnerabilities are growing, it acts as a beacon for financial accountability.

The Zero Liability Principle serves as a vital safety net for customers navigating an increasingly intricate and precarious financial environment in a time when digital transactions are the foundation of contemporary banking. In addition to codifying strong safeguards against unauthorized electronic transactions, the RBI’s 2017 framework rebalanced the fiduciary relationship by putting financial institutions squarely in charge.
